Limited Warranty/Limitation of Liability

Pittman Dental Laboratory (“PDL”) warrants that all dental devices (a “device”) are made according to your specification and approval in the belief that the device will be useful and makes no other warranties including, but not limited to, any implied warranty of merchantability or fitness for a particular purpose. This Limited Warranty and Limitation of Liability (“Agreement”) will be extended with the presentation of a verified proof-of-purchase, which includes an original invoice number/date, patient’s name, and the original model. This limited warranty extends only to the original purchaser of a device and does not extend to patients or other individuals and/or entities to whom the device(s) is/are sold, implanted, inserted, or delivered. Subject to the return of a device that is placed and then fails due to defects in materials or workmanship, the lab will repair or remake the device without charge or for a partial charge based on original invoice price, at the lab’s option, as follows:

(1) porcelain to metal restorations, metal free restorations, all metal restorations, single-unit inlays, onlays, and screw-retained titanium or zirconia abutments (excluding abutments with angulations greater than 20 degrees), up to five years; (2) dentures and partials but excluding immediate dentures and partials, up to one year; (3) orthodontic appliances, thermoformed appliances, splints, acrylic temporaries, acetyl resin appliances, immediate dentures and partials, flippers, surgical and radiographic guides, and all other dental devices up to 30 days (4) Flexible partials up to 6 months only if 5mm or more of Vertical Dimension of Occlusion exists. (5) Screw-Retained Acrylic Hybrid and Zirconia Hybrid will be remade at no charge due to poor fit only if the prosthesis does not fit the model and the model has been returned with the prosthesis for remake. Lab is not liable for all other costs of adjustment, repair, and replacement of device. If the prosthesis breaks during the delivery appointment and the lab’s screw-retained hybrid protocol for verification jig was not followed, warranty is voided. Screw-Retained Acrylic Hybrid up to 30 days for failure of acrylic or denture teeth, titanium bar against breakage up to 5 years. Zirconia Hybrid against breakage of Zirconia up to 5 years. This warranty does not apply if the models were not verified using an intra orally luted verification jig. Except where prohibited by law, the lab will not be liable for any loss or damages arising from the use of a device, whether direct, indirect, special, incidental or consequential, regardless of the theory asserted, including warranty, contract, negligence or strict liability and if such disclaimer is not permitted by law, the duration of any implied warranty is limited to 90 days from the date of delivery. The lab does not guarantee the performance of independent carriers. PDL will only accept returns of implant parts on un-opened packages with the product in its original condition and within expiration date. The parties to this Agreement mutually agree to waive all class actions in favor of mandatory individual arbitration of all claims arising out of, or related to, this Agreement. Any controversy or claim arising out of, or relating to, this Agreement, or the breach thereof, shall be settled by arbitration administered by the American Arbitration Association. The place of the arbitration shall be Gainesville, GA and Georgia state law shall apply.

Credit & Remake Policy

Pittman Dental Laboratory (“PDL”) warrants that a remake or credit will not be applied under the following conditions:

1) If a remake or credit is requested because the customer requests a tooth shade different from the original shade request.

2) If a remake or credit is requested due to treatment plan change or materials change from original request.

3) If a remake or credit is requested for immediate/surgical partials or dentures or treatments with healing extractions.

4) If a remake or credit is requested because the appliance fits the model but does not fit in the mouth.

5) If a remake or credit is requested and the remake reason is not specified, and original materials or appliance(s) are not returned.

6) PDL’s remake or credit policy will not apply to any account past due. PDL reserves the right in its sole discretion to refuse to accept any new cases and process remakes or credit cases until the balance is paid in full and the account is current.

A non-refundable charge will be applied if the original appliance is not returned at the time of remake request. PDL can amend the remake or credit policy at its sole discretion and without prior notice.

Pittman Surgical Solutions - Implants and Guided/Non-Guided Products

Remake Policy 
Remake Policy: Pittman Dental Laboratory ("PDL") warrants that a remake credit will not apply under the following conditions: 
If a remake is requested after the lab deemed the provided case materials incomplete and/or unsatisfactory and customer elects to proceed with the completion of the case without making any adjustment, refuses a try-in, or does not supply requested materials.

Bundles vs À la Carte Packages

Surgical bundles are billed upfront, while a la carte options will be billed sequentially throughout the course of treatment and are non-refundable.

Facial Scanner Limited Warranty
Pittman Dental Laboratory, Inc. (“Pittman”) provides the following “Facial Scanner Limited Warranty” to the first purchaser of each new Scanner machine.

1) WARRANTY PERIOD:
Subject to the terms of this warranty. Pittman warrants to the first purchaser that the new Scanner machine will be free from defects in material and workmanship for the warranty period set forth below. The warranty period starts at the time the machine is first placed into service by anyone.
• New Scanner Warranty Period – 12 months.
2) THE FACIAL SCANNER LIMITED WARRANTY DOES NOT COVER:
• 12 months upon date of receiving, we will guarantee to keep the goods in repair for free, including but not limited to sending-back repair, on-site repair, parts replacing, this term only based on normal using.
• Any machine which has been altered or modified in a manner which, in the sole judgment of Pittman, affects its performance, stability, or reliability, including the use of non-approved attachments.
• Depreciation or damage caused by normal wear and tear, by failure to properly maintain the Scanner machine, improper use or abuse of the machine, collision, fire, or other accident, vandalism, negligence, other casualty or operation beyond rated capacity or specifications.
• Parts or components that are covered by separate and specific warranties, including warranties extended by other parties.
• We will neither warrant the circuit board burn out nor water leak, in this case, redemption is suggested
• Accident or damage caused by the environment, such as but not limited to, exposure to corrosive or hazardous materials.
• Scanner machines without a dongle number and information on purchase method. BOTH DONGLE NUMBER AND PURCHASE METHOD ARE REQUIRED IN ORDER TO SECURE THE LIMITED WARRANTY CONTAINED HEREIN.
• Costs associated with pickup and delivery of the Scanner machine, rental of replacement equipment during the repair period, economic loss during the repair, overtime labor charges, travel time, mileage or zone charges, and freight charges of replacement parts.
3) SECURING WARRANTY SERVICE:
• Pittman will, during the applicable warranty period, repair or replace, at its option any component, parts, or the entire Scanner machine (except those specified above) that, as delivered to the original purchaser, are defective in material and workmanship. Pittman will determine in its sole discretion, whether a defect or failure is covered by this warranty. No charge shall be made to the purchaser for parts and reasonable labor incurred in making the repairs.
• Warranty repairs will be performed after delivery of the machine or defective part to Pittman. At the time of requesting the warranty service, the purchaser must present evidence of the method and date of purchase as well as the dongle number associated with the Scanner machine.
4) NO REPRESENTATIONS OR IMPLIED WARRANTIES:
THIS LIMITED WARRANTY IS THE ONLY WARRANTY MADE BY PITTMAN DENTAL LABORATORY, INC., A GEORGIA CORPORATION, AND ITS AFFILIATES AND NEITHER PITTMAN NOR ANY COMPANY AFFILIATED WITH PITTMN MAKES ANY OTHER WARRANTIES, REPRESENTATIONS, OR PROMISES, EXPRESS OR IMPLIED, AS TO THE QUALITY, PERFORMANCE, SERVICE, REPAIR, TRANSPORT, OR OTHER USE OF SCANNER MACHNES OR COMPONENTS THEREOF. PITTMAN EXPRESSLY EXCLUDES AND DISCLAIMS ANY AND ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE AND MERCHANTABILITY.
NO PERSON IS AUTHORIZED TO MAKE ANY REPRESENTATIONS, WARRANTIES, OR PROMISES ON BEHALF OF PITTMAN OR ITS AFFILIATES, OR TO MODIFY THE TERMS OR LIMITATIONS OF THIS WARRANTY. THIS WARRANTY IS PROVIDED EXCLUSIVELY TO THE FIRST PURCHASER OF QUALIFYING SCANNER MACHINES AND MAY NOT BE ASSIGNED OR OTHERWISE TRANSFERRED.
5) REMEDIES EXCLUSIVE:
THE SOLE AND EXCLUSIVE REMEDY OF ANY PERSON, AND THE SOLE AND EXCLUSIVE OBLIGATION AND LIABILITY OF PITTMAN AND ITS AFFILIATES, WITH RESPECT TO ANY SCANNER MACHINE OR COMPONENTS IS THE LIMITED WARRANTY SET FORTH HEREIN. PITTMAN WILL IN NO EVENT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OR INJURIES CAUSED BY ANY MACHINE OR ITS COMPONENTS, WHETHER ARISING IN CONTRACT OR IN TORT, INCLUDING BUT NOT LIMITED, TO LOSS OF PROFIT, BUSINESS INTERRUPTION, COST OF RENTAL, OR SUBSTITUTE EQUIPMENT, OR ANY OTHER COMMERCIAL LOSS OR FOR DAMAGES OF ANY KIND WHETHER OR NOT PITTMAN AND ITS AFFILIATES HAVE BEEN ADVISED OF OR COULD HAVE FORESEEN THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL PITTMAN’S LIABILITY TO ANY PERSON REGARDLESS OF THE FORM OF ACTION EXCEED THE PURCHASE PRICE OF THE SCANNER MACHINE.
